way in the sex and it is interesting but i think brian one of the most interesting things is senator john mccain he himself detained and held as a prisoner of war for years during the vietnam time seems not to care for senator rand paul's amendment what's going on here. mccain has become the worst sort of defense off and die they're all since two thousand a public ng convention back in august where rand paul got off and was willing to say hey if we're serious about cutting spending we have to look at the fences well mccain comes on i know you know you can touch it and you have defense mccain i think is just pandering to this sense that we are under great risk and great threat which which in fact as we can tell we're not and that any any respect for the constitution any talk of putting the spending by a penny is somehow being soft on r. and b. it's not true and it's sad that mccain who as you said should know better or should respect the rights of detainees in a less terrible on this issue and tell you what it certainly is interesting being here in washington for not even months but years

let's begin with general john allen. we're talking about 20,000 to 30,000 pages of e-mails, many of them to jill kelley. it really seems like an incredible amount of e-mail traffic between a high-ranking general and a woman who really is just a volunteer for the military. how unusual is this? and what does it all mean? >> well, on the face of it, alina, it's staggering that sheer amount of documents that you mentioned, 30,000. we're told by a u.s. official that all 30,000 do relate directly to general allen. but, when you peel back the layer a little bit, not all 30,000 may contain inappropriate content. in other words, some of them may have been something simply as a name in the subject line or something mentioned in the e-mail that there may be mixed into that a good number of legitimate e-mails between the two or concerning general allen and some in there which they thought may be appropriate that they're going to take a look at. general allen is telling defense officials that we heard this morning that he's done noth

but my sense is that john boehner would like to fight these issues just on economics. he doesn't want to deal with the social stuff. he views that as baggage. if boehner had his way we would be fighting just over taxes. he thinks he has the upper hand on that one. >> but they're still wedded to supply-side economics. it's just as a nutty idea as creationism. it's just a different context. every reputable economist will tell that you it doesn't work but they cannot breakaway. boehner seems to be trying a little bit but i don't buy this whole thing of closing the loopholes and having the upper 1% sacrifice a little buttnier money is moving us closer to equity. but i think boehner is nudging closer on that issue. >> eliot: i don't know that he equates supply side with creationism. i think supply side is nutty and creationism is three steps beyond it. the democratic party scored a huge win. the senate races were a huge win. but it seems to me there is not a coherent narrative coming out of the white house, and they came out and spoke on same sex issues, the healthcare act,

it's john roberts agenda and it has not yet succeeded. it may never succeed but it is an agenda to change many of the important residents at the supreme court and that's why roberts is the candidate of change. and obama is saying leave things the way they are. >> eliot: you're saying as a matter of constitutional doctrine, row versus wade, on and on, the president said we're happy where things are. >> that's right. and you see the lack of relative discussion on these issues. george w. bush, whatever you think of him paid attention to constitutional issues. he didn't want judges who legislated to the bench. he held high profile ceremony on primary time to nominate his first group of judges. you never hear any that have from barack obama because it's not a priority. >> eliot: where does that leave us? take the gun case and the heller case which was viewed as an expansesive interpretation of the second amendment. who won-- >> no, barack obama--this is the thing, the democratic party made a decision. chuck schumer has even talked about this,

joining me with more on this, republican senator from north dakota, john hoeven. senator, thank you so much for joining us. give us your take on today's meeting. what happened? >> good to be with you, melissa. i think you said it just right, cautious optimism. i think we laid out the construct that could lead to a big deal and we need to do it. melissa: what is that construct? what do you think the final deal looks like? >> pro-growth tax reform, entitlement reform and better spending control and a deal that is in that four to 6 trillion dollar range. melissa: what is pro-growth tax reform? to me that, from a republican sounds like the closing of loopholes and not raising of marginal rates? >> well it is closing loopholes. it is limiting deductns and then getting revenue from growth. and that's really the only way you will get revenue because you have to have the economy grow. if you start raising those rates you will have just the other effect. you will have a shrinking economy. you will not get more revenue. so we are putting revenue on the table the right way.
